TUPE in its introduction has brought with it the principle that an employee transfers across to its new employer with all of their rights, liabilities and obligations in relation to them.
In addition to this, these transferred employees are protected against being dismissed as a result of the transfer to the new employer.
Employers and the new employer are under an obligation to ensure that the employees are informed throughout the process.
TUPE only applies to “relevant transfers”. These can be a transfer of a business or part of a business where the economic entity retains its identity (Business Transfer) and where a client engages a contractor to do work on its behalf and reassigns such contract (Service Provision Change). A Service Provision Change covers both in-sourcing and out-sourcing the contract.
